Special Court convicts a Nangloi Tyre Showroom owner of power theft

…..Sentenced to one year jail and penalised Rs 3.3 lakh

  • Accused was earlier caught by BSES Enforcement for stealing 11 KW of power and penalised Rs 4.19 lakh
  • Accused did not pay the penalty amount till the stipulated date
  • Thereafter BSES moved Special Court of Electricity where the accused pleaded “Not Guilty”
  • After hearing all arguments and going through evidence, the Special Court pronounced the accused guilty

The luck of Anwar Ali – owner of Hira Tyres in Nangloi – ran out when the Vikaspuri-located Special Court of Electricity convicted and sentenced him to a one year jail term and also imposed a penalty of Rs 3.3 lakh for stealing power.

 

Earlier in an inspection on June 3, 2006, Anwari Ali was caught red-handed stealing 11 KW electricity at his Tyre Showroom at A-2 Main Najafgargh Road, Near Hanuman Mandir, Nangloi. The three phase supply of Anwar Ali’s showroom was found directly hooked to the LV Mains. Subsequently, according to the provisions laid down in the Indian Electricity Act 2003, a penalty of over Rs 4.19 lakh was imposed on him. When the accused, failed to deposit the penalty amount within the stipulated timeframe, a case was filed in the Special Court on August 10, 2007.

 

On his part, the accused took the plea that he is innocent and has been falsely implicated in the case. After hearing the arguments of both the sides and taking note of the evidence presented by BSES, the Special Court of Electricity pronounced the accused guilty of theft of electricity and sentenced him to undergo an imprisonment of one year. In addition, the Court also determined a Civil liability of Rs 3.30 lakh against the convicted person u/s 135 of the Indian Electricity Act 2003.

 

Power theft at Nangloi

 

Nangloi is one of the areas where the incidence of power theft is still high.  Direct Hooking is the favoured mechanism to steal power in the area – which is then mainly used for industrial and commercial purposes. So far, BSES Enforcement teams have conducted around 2000 raids in the area, booked over 22,500 KW of electricity theft load and levied nearly Rs 40 crore in penalties”.
