Special Court bars Toy manufacturer from getting electricity, fined Rs 1.18 cr, 18 months RI
2nd time offender - Owner of industrial unit housing toy manufacturing, printing press and electroplating works was caught stealing 118 KW of power
1st time convicted for stealing 112 KW of power – sentenced to 15 months Jail and fined Rs 52 lakh
In another case, father and his two sons sent to Jail for assaulting BSES enforcement officials
In a significant judgment, giving a strong message to power-thieves, the Special Court of Electricity, Dwarka, has not only imposed a fine of Rs 1.18 crore and sentenced owner of a Toy manufacturing unit to 18 months Rigorous Imprisonment (RI), but also barred him from getting electricity from any source for a period of three months. In another case, the Special Court of Electricity, Karkardooma, has remanded a father and his two sons to 14 days jail for assaulting BSES Enforcement officials.

Mr Virender Sehrawat, owner of a mid-sized industrial unit, housing toy manufacturing, printing press and electroplating works has been convicted for power-theft and fined Rs 1.18 crore, sentenced to 18 months RI and barred from getting electricity for three-months by the Special Court of Electricity, Dwarka.
Incidentally, this is the second time in less than 12 months that the Toy manufacturer has been convicted for power-theft. For his earlier conviction, he was penalized Rs 52 lakh and sentenced to 15 months Simple Imprisonment (SI), which he is presently serving. Both his sentences will run concurrently.
Rejecting the plea of leniency of the accused, the Order says, “There does not appear to be any mitigating circumstance to show leniency in his case…and in view of proviso to section 135 of the Electricity Act, 2003 convict is liable for enhanced punishment as referred above”
“Keeping in view all the facts and circumstances, I am of the considered view that convict be sentenced to RI for a period of 18 months and fine of Rs 1,18,38,576/-. In default of payment of fine, accused shall undergo SI (Simple Imprisonment) for a period of 3 months”
“…..since the accused Virender Sehrawat happens to be a habitual offender and has been convicted for the 2nd time, he is also debarred from getting electricity any supply of electricity for a period of 3 months and for the aforesaid period, he shall also be debarred from getting supply of electricity from any other source of generation”
“I deem it appropriate that out of the fine realized, amount of Rs 39, 46,192/- towards civil liability shall be paid to the complainant….”
During the trial, the accused contended that he was not the owner of the premises and was merely tying his cows just outside the inspected premises. He also contended that one Sanjay Tiwari and Santosh Yadav were the owners of the inspected premises. Both of these contentions could not hold ground in face of strong evidence by the legal team of BSES Rajdhani Power Limited (BRPL).
Earlier, in August 2007, the accused was caught stealing 118 KW (106.22 KW industrial + 5.95 KW domestic) of electricity by bypassing the meters and hooking from the nearby BSES LV mains. He was penalized Rs 41.99 lakh.
Father and his two sons sent to Jail for assaulting BYPL Enforcement Team
A father and his two sons, who had assaulted a BSES Yamuna Power Limited (BYPL) Enforcement team have been taken under judicial custody and remanded to Tihar Jail for 14 days by the Special Court of Electricity, Karkardooma.
Residents of Zafarabad’s Indira Chowk, Ahmed Ali and his two sons – Arshad and Johar – had assaulted members of a BYPL enforcement team when they had gone to inspect a tip-off regarding large scale power-theft taking place at 645, Gali No 26, Indira Chowk, Jafarabad. The accused not only did not let the enforcement team inspect the premises, but manhandled the company officials.
Post the incident, a Police complaint was registered under various sections and the trio was arrested by the Police. They were then produced in the Karkardooma Court, where they applied for bail. Looking at the gravity of the offence, their application was rejected by the Court.
