‘manufacturers’ sent to Tihar for power theft,
Bail
Application of one rejected
Besides
the Earth Hour, the past 3-4 days have also seen positive action on another
level also. In three different cases, Special Court of Electricity, Patparganj
remanded three illegal factory owners to Judicial Custody for stealing
electricity. While Meharban and Mohd Sadique were remanded for a period of 14
days each, Vipin Kumar was remanded after his bail application was rejected by
the

the three were caught cumulatively stealing over 68 KWs of electricity. They
had been arrested and produced before the
Case of Vipin Kumar
Of
the three, the case of Vipin Kumar – caught running an illegal factory
manufacturing ‘brass tapes’ - is the most interesting. A BSES Enforcement raid
carried out at the factory premises (Dilshad Garden Industrial Area, Shahdara)
in March 2008 had found the factory running on stolen electricity. Though the
factory had a sanctioned load of 40 KW, it was found to be illegally drawing
around 26 KW of electricity from a nearby BSES LV Main. The on site meter was
found burnt. Subsequent investigations revealed that the meter has been
deliberately burnt to hide records of the past consumption and its evidence.
The
accused (user of the factory) and the registered customer kept on ignoring the
show cause notices sent by the company repeatedly. Subsequently, according to
the laid down Indian Electricity 2003 guidelines, a penalty bill of Rs 7.86
lakh was imposed on the accused. When the accused failed to deposit the same
within the stipulated time frame, BSES registered a FIR. Post which Vipin Kumar
was arrested and produced before the
The
bail application moved by the accused, arguing that he was only an employee at
the factory and not its owner, could not stand scrutiny to the evidence
gathered by BSES and hence was dismissed by the Court. It was proved beyond
doubt that the accused himself was running the factory.
Case of Mohd Sadique
A
BSES enforcement raid at a non descript Jhuggi (E 1212/70) in Seelampur in July
2008 had found large scale (direct) power theft (totaling nearly 22 KW) taking
place. Of this 8.2 KW was being used to run a mid sized plastic moulding
factory on the 2nd floor and 13.29 KW for domestic purposes on the
ground and the 1st floors. No meter was found at any of the
premises.
Subsequently
a penalty amount of 4.34 lakh was imposed on Mohd Sadique, the owner and user
of the premises. When the accused failed to deposit the amount within the
stipulated timeframe, BSES registered a FIR against the accused.
Case of Meharban
A
BSES enforcement raid in August 2006 found large scale power theft of around 25
KW taking place at B 3/100 Brij Puri, Karawal Nagar. In this case too, the
stolen were was being used for both industrial and domestic purposes. While
21.36 KW was being used for industrial purposes (running a factory), around 3.5
KW was being used for domestic purposes. Though the premises had two
electricity meters, they were both found disconnected. The power was being
stolen by tapping into the nearby BSES LV Mains.
A
penalty of Rs 9.15 lakh was levied on the accused. When the accused, Meharban,
did not pay the amount within the stipulated period of time, a FIR was
registered.
