Subsequently, the accused made a bail application before the Court, which was granted on April 24, 2007 – but this was after the accused had spent four days in jail. While accepting the bail plea, the Court directed the accused to deposit Rs 6 lakh (Rs 2 lakh on an immediate basis and Rs 4 lakh by 31 May 2007) as interim amount with BSES as payment towards the penalty bill. The SPD contractor was caught by a BRPL Enforcement Team on January 19, 2007 stealing and illegally distributing electricity.

The contractor, was permitted by BSES to supply 30 KW of electricity to around 85 customers in the area. However, he was found stealing and illegally distributing over 135 KW to significantly more number of customers – by using three aluminum wires to tap directly from BSES’ service line. A penalty bill of over Rs 21 lakh was imposed on him. Subsequently, a case was filed in the Special Court.
